NEW COLLEGE OF FLORIDA EMPLOYMENT CONTRACT FOR
OUT-OF-UNIT
ADMINISTRATIVE & PROFESSIONAL EMPLOYEES
1. This contract of employment between
New College of Florida Board of Trustees (College) and the undersigned
employee is subject to U.S. and Florida law and College rules, policies,
and procedures, which are incorporated herein by reference and made
a part hereof. This document is effective, final and binding upon the
parties when signed by the employee and the College representative acting
as appointing authority, and supersedes any and all prior employment
contracts.
2. Except as provided in paragraph 5 below,
this contract will automatically be renewed annually on August 7 of
each calendar year, unless the employee resigns from the College, the
College terminates this contract for cause, or the College elects to
cancel this contract without cause as stated in paragraph 4 below.
3. Employment under this contract is subject
to satisfactory performance of assigned duties. The College may terminate
this contract for cause as provided by its rules and/or policies.
4. At its option, the College may elect
at any time to cancel this contract without cause as follows:
(a) By providing
advance written notice to the employee of cancellation (six months notice
for employees who have one or more years of College Administrative &
Professional service; three months for all others). Employment will
cease at the end of such notice period, notwithstanding any other date(s)
of appointment indicated below or elsewhere; or
(b) Upon payment to the employee of an amount, less withholding, equal to one of the following, as applicable:
(i) six
months salary for employees with one or more years of College Administrative
& Professional service;
(ii)
three months salary for employees with less than one year of College
Administrative & Professional service;
(iii)
salary for the remainder of the appointment period or six months salary,
whichever is less, for employees appointed under paragraph 5 below having
one or more years of College Administrative & Professional service;
or
(iv)
salary for the remainder of the appointment period or three months salary,
whichever is less, for employees appointed under paragraph 5 below having
less than one year of College Administrative & Professional service.
(v)
Employment will cease at the time of such payment. No retirement
or other benefits will attach to such payment.
5. The following additional provisions apply to employees holding visiting, acting, or provisional appointments; employees appointed for less than one year; or employees who are funded by any contract, grant, auxiliaries or local funds (i.e., "soft money"):(a) The automatic renewal provision stated in paragraph 2 above is not applicable, and this contract will end on the date indicated below or on the most recent
appointment extension
without further notice, unless otherwise terminated, cancelled or extended
as provided herein; and
(b) Appointment
extensions for soft money funded positions will be done by Appointment
Form. If an Appointment Forms is not submitted, the ending date
of this contract will automatically be August 7.
6. Any changes in appointment and/or salary
increases hereafter shall be so designated on an Appointment Form. The
employee has an obligation to report outside employment activity / conflict
of interest in accordance with College policy.
