CONTRACT FOR THE HOSTING OF THE 

IBSA CHAMPIONSHIPS  
 

This contract, executed  this                  day of                     , 00in Madrid (Spain), between the International Blind Sports Federation (hereinafter referred to as IBSA), and the Organizing Committee of the Championships, (hereinafter referred to as the OC) witnesses that:

PREAMBLE  

Whereas IBSA governs the sports movement for the blind of the world and owns all rights over 00 

Whereas 00has proposed that the Championships be hosted in the City 00 and that proposal has been accepted by IBSA;  

Whereas the hosting parties are desirous of staging the Championships in full compliance with the provisions of this contract; 

Whereas it is the mutual desire of IBSA and the OC that the Championships will be organised according to IBSA sport technical provisions and instructions which are enclosed to the present contract as Appendix 00, in the best possible manner and take place under the best possible conditions for the benefit of the IBSA athletes of the world to contribute to the further development of the blind sports movement throughout the world. 
 

COMMITMENTS 

Now, therefore, in consideration of the foregoing and the covenants and conditions set forth hereafter in this contract, the parties hereto agree as follows:

Section 1. Organisation of the Championships  

IBSA hereby entrusts the organisation of the Championships to the IBSA national member with full rights and the OC, which undertake to fulfil their obligations in full compliance with the provisions set forth in this contract. The IBSA national member should be in good standing. 

Section 2. Special Provisions 

The parties agree as follows: 

2.1. Sole Responsibility: The OC shall be individually and solely liable for all commitments entered into concerning the organisation and staging of the Championships including all obligations deriving from this contract. The OC will comply to its financial commitments and will be severally liable for any budget deficit as benefit from budget surplus, resulting from the organisation of the Championship. It will be assured to IBSA non liability to organisational or economic concerns.       

The OC will sign an insurance contract up to the amount of a minimum of 00per occurrence for third party (public) liability and for participants. A copy of the contract will be sent to IBSA no later than three months prior to the opening of the Championships.  

2.2. Date of the Championships: the Championships shall take place from 00 

2.3. Organisation of OC: the hosting parties undertake that among the OC Board of Directors and steering committee there shall be two members representing IBSA. The parties agree that this undertaking is absolutely essential so as to ensure the smooth planning and executions of the Championships. 

2.4. Observance of Decisions: the OC shall obey reasonable decisions made by and/or orders given by IBSA or any of its appropriate bodies as long as such decisions or orders relate to the Championships, are in full compliance with this contract and do not imply unreasonable additional expenses for the OC. 

2.5. Co-ordination Commission: the parties agree that the IBSA Co-ordination Commission shall also serve to manage the working relationship with IBSA. The OC shall also meet the costs and assist in organising the visit of the technical representatives for the inspection of venues prior to the Championships. 

2.6. Entry fee: in exchange for services provided to competitors, team officials, athlete support personnel and other team personnel, the OC is authorized to require from each of these participants an entry fee as approved by IBSA.   

2.7. Health Services: all necessary first aid medical/health services of an emergency or pressing nature shall be provided, without cost, to the accredited competitors, team officials and representatives of IBSA at each sport venue. 
 
 
 

2.8. Doping and Drug Testing: the OC shall secure the necessary means to conduct doping and drug testing as specified in the IBSA rules and the WADA code. The OC shall meet the costs. 

2.9. Visual Classifications: the OC shall secure the necessary means to enable the IBSA Medical Department to conduct required visual classifications of the athletes. The OC should communicate with the IBSA medical director about this matter at least sixty (60) days before the beginning of the Championships. 

2.10. Transportation and Travel:  

2.10.1. The payment of the travel expenses in economy class of the duly qualified and accredited technical official and classifiers to the host city from his/her country of residence shall be borne by the OC.  

2.11. Sports venue: the OC shall provide appropriate accommodation, services and facilities reserved for the competitors, team officials, athlete support personnel, other team personnel and technical and medical officials.  

2.11.1. The accommodation area for technical and medical officials shall be located separately from that of athletes and team officials.   

2.12. Sports Program: the specific daily program shall be submitted by the OC to IBSA for information no later than one (1) month before the Championships. 

2.13. Venues: the competition, non-competition and training venues used for the Championships shall respect any special requirements for disabled participants that may be contemplated in the IBSA rule book in effect as of the date of this contract. 

2.14. Admission tickets: the OC reserves the right to charge an admission fee, which price should be agreed upon by IBSA. The OC shall ensure that no entry fees are charged for athletes and team officials.  

2.15. Marketing Programs: the OC acknowledges that the Championships are the exclusive property of IBSA and that IBSA owns all rights of whatever kind or nature concerning their organisation, publicising, broadcasting, recording, marketing and reproduction by any means whatsoever, whether now existing or developed in the future.  The OC shall ensure that the IBSA name and logo appears on all material in any format produced for the purpose of promoting the Championships and on all merchandise produced for use during the Championships and/or sale to the general public. The IBSA flag shall be raised during the Opening Ceremony of the  
 

Championships and shall be flown and/or displayed prominently at all times at all sports facilities used for the Championships.  

2.16. License: IBSA herewith grants for the period from the date of this contract until 00 an exclusive license to the OC to use IBSA rights for the organisation, publicising and marketing 00xcluding broadcasting, recording and reproduction 00f the Championships (necessary or appropriate for the OC to perform its obligations under this contract and to raise the revenues to enable it to do so), provided, however, that such license (i) is exclusively granted relating to the Championships; (ii) is subject to the OC complying with all the provisions of this contract; and (iii) is subject to IBSA being satisfied as to the protection of IBSA麓s rights in the host country and in other countries, where necessary. 

2.17. OC Reports to IBSA upon conclusion of Championships: upon conclusion of the Championships and subject to the conditions enumerated hereafter, the OC shall send, no later than two months after the end of the Championships, the official report on the results of the Championships both to the Secretary General and the IBSA Statistician for record purposes.  

2.18. Capitation Fees: the capitation fees should be transferred to the IBSA Treasurer after the completion of the Championships. See Appendix 1 00BSA Capitation Fees. Form and Invoice00  

2.19. No Previous Commitment: the hosting parties hereby declare that neither of them is a party to, or bound by, any undertaking or agreement (other than those made with the approval of IBSA) concluded prior to the executions of this contract and having any connection whatsoever with the Championships in terms which are inconsistent with this contract. 

2.20. Governing Law and Dispute Resolution: inasmuch as IBSA is registered in the Spanish Sports Council (Consejo Superior de Deportes de Espa帽a), and due to the fact that the 00. organization is in 00, this contract shall be governed by the laws of Spain and the laws of 00.. Any dispute concerning its interpretation or the rights or obligations of the parties under this contract or any other matter arising from this contract is to be submitted to and decided by  000000.. 

2.21. Language: all communication in connection with this contract, either in written, oral or any other form shall be conducted in English or Spanish.
