Policy Behind the Changes 
T&M Commercial Contracts 

Former Rule:  Commercial T&M contracting not authorized. See FAR 12.207. New Rule:  Implements Services Acquisition Reform Act (00ARA00; OFPP designated that all categories of services can be procured on T&M basis.  Based on findings that an array of commercial services are commonly sold to the public on a T&M basis.

T&M is driven by whether the scope of work is defined well enough to allow for fixed-price terms.  If it is not, then T&M is appropriate.

T&M Non-Commercial Contracts 

Former Rule:  Unclear on bases for payment under T&M/LH contracts for non-commercial items. New Rule:  Re-defines 00aterials,00and 00ubcontract labor00to clarify how payments are made under non-commercial T&M contracts.  Provides for payment based on for separate or blended fixed hourly rates, or a combination thereof.

The new rule clarifies significant items such as subcontract costs, ODCs, and certain indirect costs that may be appropriate for an acquisition.

DoD T&M Non-Commercial Contracts 

Interim Rule:  DoD mandates separate fixed hourly rates including profit for each category of labor performed by the contractor, each subcontractor, and transferred between contractor divisions, subsidiaries, affiliates.

The interim rule accounts for large dollar value of DoD procurements; recent scrutiny of DoD procurements; and the preponderance that DoD contractors have the capability to establish separate rates.
